The Georgia Film credit grants a tax credit to production companies that incur expenditures in Georgia. The credit includes a 20% base credit and a 10% uplift credit for embedding the Georgia logo on approvide projects. The credit is transferrable, providing a benefit even if there is no expected GA tax liability.

Is there a limit on the credit amount?

There is no upper limit to the amount of expenditures that can qualify for the credit and, therefore, the amount of the credit. However, the credit requires a minimum expenditure of $500,000.

What types of projects are eligible for the credit?

The following projects may qualify for the credit:

  1. Feature Films
  2. Television series, pilots, or movies
  3. Televised commercials
  4. Documentaries
  5. Music Videos
  6. Interactive media including games and animated films.

What are the steps to claim the credit?

  1. Fill out Application(s) fully before submitting for review.
  2. Submit Application(s) with required supporting materials: script and proof of funding.
  3. Once received the Application(s) are reviewed to determine if the project meets eligibility requirements.
  4. If approved, the production company receives a 20% certification letter stating the project meets the eligibility criteria for certification to be awarded.
  5. The production company produces original content in Georgia.
  6. The production company fulfills the reporting requirements and submits the supporting materials.
  7. If required, production company completes an audit.
  8. Production company files a Georgia income tax return.
  9. When the project is distributed, and if the production company applied for the 10% GEP Logo Uplift, the production company completes and submits the Distribution Form to generate the 10% certification.

When is an audit required?

For 2021, if the credit exceeds $2.5 million, then an audit is required before utilization or transfer of the credit.

In 2022, audits are required for credits that exceed $1.25 million. After 2022, audits will be required for all credits

When should I start the process to claim the credit?

The best time to submit the application is when the project is green-lit, fully funded, and ready to open a production office.
